Stärkung der Ombudsstelle

With the coming into force of the Financial Services Act (FinSA) and the Financial Institutions Act (FinIA), the ombudsman will be strengthened by being regulated by law and by obliging the financial service providers and financial institutions to join the institution. This approach is consistent with the international trend as well as with the tradition of the Swiss arbitration procedure. In addition, customers are offered an incentive to go through the ombudsman procedure by being able to refrain from carrying out a conciliation procedure in a subsequent civil process. Both parties have the opportunity to call an independent, state-recognized ombudsperson with specific expertise without thereby ­limiting the general procedural rights and restrictions.
